Rothfelder on the IBO Conference and Drafting and Litigating Leases

Richard & Chris Rothfelder and Mike Falick

Chris Cowlbeck, Becky Smith, and the entire crew at IBO have once again scheduled a fun and informative Fall Conference at the Hyatt Regency Hotel in Indianapolis for October 3 through 6. It all starts with a golf tournament at Hillcrest Country Club on Tuesday, followed by great sessions during the day on Wednesday and Thursday, with networking and dinners those evenings at Back 9 Social and Skyline Club.

There is the usual impressive line up of speakers, including our friends from OAAA Mike Hershey and Anna Bager. Dave Westburg of Billboard Insider is moderating another of his panel discussions on cutting edge industry issues. In between these and many more interesting presentations there will be plenty of opportunity to catch up with friends and colleagues from across the country over a beer or coffee.

And, of course, there will be the usual legal presentation by Yours Truly, this time on Drafting and Litigating Leases and Easements. Mike and I will be the presenters, with Chris sitting this one out, as he is expecting his first child and my first grandchild in just three weeks.

The power point presentation is attached, and it will cover the following and more topics regarding billboard leases:

  • Requirements for a writing and the statute of frauds
  • Filing the lease or a memorandum of lease in the real property records
  • Foreclosures and subordination agreements
  • Tax foreclosures and redemptions clauses
  • Disputes over sign ownership and lease validity after sales
  • Right of first refusal clauses
  • Renewal clauses
  • Eminent domain
  • Access clauses and disputes
  • Force majeure
  • Venue
  • Attorneys fees

See you in Indianapolis!
