An arrangement between a neighborhood association and a motel owner ran into some trouble in the San Diego area. The San Diego Reader reports that Clear Channel has objected to a notice received from the owner of the Dolphin Motel to remove their billboard. The owners of the motel had made an agreement with the Point Loma Association to remove the billboard on motel property in return for the Association’s support in waiving a handicapped parking requirement to allow for an expansion of the motel. When the motel owner notified Clear Channel to remove the billboard, Clear Channel responded with a letter to the San Diego city attorney requiring compensation for the removal of a lawfully erected and permitted structure. The motel expansion is now held up as city approval was conditional on the billboard removal.
Inisder’s take: Good for Clear Channel in standing by their rights as they hold a valid permit. Will be interesting to see how this gets resolved.
