Rothfelder On IBO Pittsburgh Conference

Richard Rothfelder, Partner, Rothfelder Falick

IBO has scheduled it’s Fall Conference for September 22-24 at the Sheraton Station Square in Pittsburgh. As usual, Chris Cowlbeck and his staff at IBO have planned a fun and educational agenda, all live and in person, but with appropriate health and safety precautions.

Included among the exciting evening events on the Gateway Clipper and at the Church Brew Works are a couple of sessions I know the audience will also enjoy. First, Billboard Insider’s own Dave Westburg will be monitoring a respected panel of professionals on Billboard Asset Acquisitions. Specifically, my partner Chris Rothfelder will address the legal issues and documentation in billboard transactions; Max Drachman will discuss the broker’s role in locating billboard assets for buyers and sellers, and in negotiating on their behaves; and Marshall Henderson of MH Media will represent the client and operator in buying or selling digital and static billboards. Come with questions for the panel, and be better prepared for your next deal with their decades of experience and advise.

Second, yours truly will present on the Supreme Court’s Consideration of Reagan and Lamar vs City of Austin. As you probably know, the Supreme Court in 2015 issued its seminal  First Amendment decision in Reed vs Town of Gilbert, holding that content based sign codes violate the Free Speech Clause of the Constitution. Other federal and state courts across the county have expanded the decision from temporary religious signage to the on-premise/off-premise distinction in most municipal sign codes and State Highway Beautification Acts, including the Fifth Circuit’s invalidation of the Austin Sign Code’s allowance of  digital signage for on-premise while prohibiting them for off-premise use in the Reagan case. The “new” Supreme Court, with the addition of the three Trump appointees, Justices Kavanaugh, Gorsuch, and Barrett, is decidedly conservative, and notedly different from the panel that decided Reed. Therefore, we’ll speculate on how the High Court may rule on this extremely important case, which is destined to govern the regulation and distinction of all types of signs for decades.

Finally, Chris Cowlbeck and I will remind you of a valuable benefit recently added for IBO members, namely the discount for attorneys fees in billboard litigation and transactions. As Chris and I have previously explained, my law firm, Rothfelder & Falick, is providing to IBO members discounts on hourly charges, fixed fees, and sometimes free services on all types of transactions and litigation confronting the billboard industry. Please see me or my partners, Chris Rothfelder and Mike Falick, at the IBO Pittsburgh conference, or contact us for more information on this IBO member discount program.

See you in Pittsburgh!
