New and Noted October 18, 2019

Lamar is stunting in Pittsburg, Kansas with a billboard which ways “Something cool is coming to Pittsburg.”  The first board went up October 14.  Another board is going up October 21.

A lawsuit filed this week by the River Rouge School District alleges Detroit Mayor Mike Duggan ordered Department of Transportation buses to not use Rover Rouge school ads on its buses.  Here is part of the statement from the school district.

“For many years, the River Rouge Schools has been advertising on DDOT buses through contracts with Outfront Media (formerly CBS Outdoors). This has been a positive relationship for both DDOT and River Rouge Schools. DDOT has been paid for this advertising campaign and River Rouge Schools has benefited from the advertising by more than doubling its student population during the time that it has undertaken this advertising campaign. This relationship has also benefitted school-age children in the City of Detroit as it has informed them and their families about the free quality educational options available to them. That relationship, however, has been ended because of an order by Mayor Mike Duggan. River Rouge Schools believes this is part of a targeted attack by the Mayor against the School District.”

Insider’s take: Apparently Mayor Duggan does not like the competition by River Rouge with the Detroit Public Schools Community District.  Any of our attorney friends out there want to weigh in on the free speech aspects of this case?  You can read the entirety of the complaint here.

Semantics matter when it comes to cannabis advertising.  The Pueblo, Colorado city counsel voted to allow marijuana shops to use the terms “marijuana” and “cannabis” in out of home ads, in addition to the use of a cannabis leaf.  The previous code restricted advertising just to the terms “medical marijuana”, “recreational marijuana” and “retail marijuana.”  Pricing is still prohibited in out of home ads.

Insider’s take:    If you are going to accept cannabis advertising you need to know the your state and local ad restrictions.  Even though most cannabis sign codes make clear that it is the shop owner, not the out of home advertising company which is liable for any fines for violating a code the bad press can hurt your business.  Clear Channel Outdoor took down a cannabis billboard which was located near a bus stop in Haverhill, Massachusetts frequented by high schoolers after a complaint from a city councilor.
