Insider reported in September that Lamar Advertising had won, again, in their prolonged battle with the City of Pittsburgh, fending off the city’s relentless attack on its iconic sign overlooking Pittsburgh from Mount Washington. The Mayor of Pittsburgh, Bill Peduto, vowed to appeal to Pennsylvania’s Supreme Court or seek reconsideration.
Our latest update, courtesy of the Post-Gazette, finds the parties before the State Supreme Court as the Mayor has been true to his word. The Supreme Court, after reviewing input from both parties, can choose to deny or accept the city’s latest petition for appeal.
A couple of quotes from the article are noteworthy, courtesy of Lamar’s counsel:
“This case is a sad example of the abuse of governmental power and the abuse of process,” wrote Jonathan Kamin, Lamar’s attorney. “For more than five years, the city has sought to destroy the billboard which has proudly sat on top of Pittsburgh’s Mt. Washington for more than 90 years.”
“The city now asks that this court ignore all of the previous precedents, and rely solely on some mythical arguments postulated by its politically appointed [Zoning Board of Adjustment],” Lamar stated in its filing.
Let’s hope that the State denies the city’s petition and perhaps this saga will come to a close.
