The Kentucky legislature has approved HB 328, a revised billboard control act to fix the previous law which a court invalidated. Yesterday the House approved an amended version by 30-6, the Senate approved the amended version by 91-3 and the measure has been delivered to the Governor. The bill amends Kentucky’s sign controls in a way that distinguishes rules based on whether a sign owner is compensated for a sign or not. Federal Courts threw out Kentucky’s previous sign law because it used an on-premise/off-premise distinction to apply rules.
