Kentucky Governor Andy Beshear has signed into law Kentucky HB 328, the legislation to revise and reinstate Kentucky’s sign rules. The bill amends Kentucky’s sign controls in a way that distinguishes rules based on whether a sign owner is compensated for a sign or not. Federal Courts threw out Kentucky’s previous sign law because it used an on-premise/off-premise distinction to apply rules.
The legislation also introduces state billboard permit fees: $250 for a new billboard permit fee and a $100/year billboard permit renewal fee.
Insider’s take: Glad to see the regulatory uncertainty finished in Kentucky. Expect to see more and more cash strapped states and municipalities use sign code revisions as a chance to impose new fees.
