Free Legal Seminar on Billboard Issues

OAAA sponsors a Legal Seminar every other year. Insider asked Kerry Yoakum, Vice President/Government Affairs, to tell us about the 18th OAAA Legal Seminar.

What is the Legal Seminar?

The substantive agenda features topics that broadly impact out of home media:  the constitutional challenge to existing regulation, local taxation, privacy, contracts, leasing, and pandemic-related legal issues.

I typically don’t like the spotlight, but I’m glad to describe this opportunity . . . and look forward to seeing many of you at the OAAA Legal Seminar.  Oh…did I mention it was FREE for all OAAA members?

Who is presenting?

Allen Smith of SettlePou-Dallas — who can explain complicated legal issues in clear, understandable terms — will describe courts’ evolving view of free-speech protections. As Insider has reported, the regulatory scheme for billboards has undergone monumental changes in the last few years as the courts view of First Amendment issues shifted to provide more protections for speech.

Virginia Seitz, Sidley Austin-Washington, DC, will discuss ongoing litigation regarding selective taxation of billboards and other forms of OOH assets. On November 6, she argued the billboard-tax case before the Maryland Court of Appeals, the highest court in the state (Clear Channel’s challenge to Baltimore’s billboard tax). A similar case is pending before the Ohio Supreme Court (Norton Outdoor and Lamar are challenging Cincinnati’s billboard tax). These tax cases are relevant to the bottom line.

The Legal Seminar also will explain disruptions caused by the pandemic and other operating issues.  Joseph Wilder and Laura Linneball, Wilder & Linneball-Buffalo, will broadly cover pandemic related issues. Jennifer Berardo, Price, Meese, Shulman & D’Arminio-Woodcliff Lake, NJ, will discuss lease disputes and related real estate issues.

Rich Zecchino, Adams Outdoor Advertising, will address client and contract issues. Gary Kibel, Davis & Gilbert-New York, will discuss the impacts of newly adopted privacy regulations and how to discuss and explain them when asked.

OAAA Counsel Eric Rubin and I will host/moderate.
