Andy, what are clean zones and why do they matter to an out of home company?
Clean zones are buffer areas established by host cities, in coordination with event producers, around event venues. They are designed to protect official event sponsors and advertisers from ambush marketing and to safeguard the event’s intellectual property.
What legal issues might be involved with a clean zone?
Depending on how a host city writes and enforces its clean zone regulations, several federal constitutional protections (First, Fifth, and Fourteenth Amendments), state constitutional protections, and other legal arguments may be available to a party adversely affected by the regulations.
What should an out of home company do if it wishes to learn more about the subject?
If they’re an OAAA member, they should read OAAA’s Fall Legal Report. If they’re not a member, they should consider becoming one, as the semiannual Legal Report is just one of many benefits available to members. That said, there are also several good news articles online that discuss past legal challenges to various events’ and host cities’ clean zones. Those articles can provide a solid foundational understanding.
